TERMS & CONDITIONS
Decco Web Designs reserves the right to change its Terms and Conditions, products and services at any time and without any written notice.
Forms Of Communication
All communication would be by telephone, e-mail, Internet and post.
Deposit
Upon acceptance of the quotation a non-refundable deposit of 3 months rental is required before work commences.
Payment
The rental will be paid by monthly Standing Order on the first working day of each month.
Minimum term is 12 months. All monthly rental invoices will be sent by e-mail
only.
The finished website will be hosted in a development area for viewing. The website will go 'live' once payment for any additional work has been received.
Payments for any additional 'Pay As You Go' services will be paid by cheque or electronic bank transfer.
Payment is due on presentation of invoice.
If the Client fails to pay then the website will be withdrawn from the hosting area until payment is made.
Late Payment
If payment is not made on presentation of invoice then any future work will have to be paid in advance before work commences.
Cancellation
There is an initial contract term of 12 months. Thereafter, the Client will need to provide three months written notice of cancellation.
Website Content
The Client will undertake to provide Decco Web Designs with all the information which the latter believes to be required for the timely and proper execution of the website, and to do so on time and in the desired form and manner.
The Client is responsible for the accuracy and completeness of information.
The completed website text is the Client’s responsibility. Decco Web Designs shall be under no obligation to provide part or all of this service without charge.
Any text supplied by the Client must be the Client’s own and not copied from a third party.
Any pictures supplied by the Client must be the Client’s own and not subject to any copyright infringement laws.
External organisations’ logos will only be inserted if the Client confirms that they are an accredited member or has permission to display another organisation’s logo.
Domain Names
It is the Client's responsibility to 're-direct' or 're-point' their existing domain name to Decco Web Designs' hosting server.
Hosting
The website will only be hosted on Decco Web Designs' servers unless the Files Refease Fee has been made.
Release of Website Files
There will be a Files Release Fee of £245 in order for the Client to host and manage the website independently. Thereafter, it will be the Client's responsibility to maintain the website files, server, and e-mail configuration.
The Client will
notify Decco Web Designs, before the start of the development, if they intend to manage the website independently. Alternatively, the Client will provide three months written notice during the rental period.
The Client will not use, alter or copy the website files for any other business purposes nor re-sell or copy the website files to third parties.
E-mail Configuration
It is the Client's responsibility to have an active 'personal' e-mail account.
E-mail account configuration on the hosting server will be undertaken by Decco Web Designs. It
is the Client's responsibility to configure their 'business' e-mail account on their own PC.
Confidentiality
Decco Web Designs will undertake to maintain confidentiality Vis a Vis third parties in respect of confidential information acquired from the Client. The Client may discharge Decco Web Designs from this obligation.
Decco Web Designs cannot use the information provided by the Client for any purpose other than for which it was obtained without the Client’s written consent. By way of exception, this provision does not apply if Decco Web Designs represents itself in civil or criminal proceedings in which this information may be relevant.
Intellectual Property
The Client will own the website but will not own the copyright to the website design nor to any pictures used on the website that have not been supplied by the Client. The website will only be hosted on Decco Web Designs' servers unless the Files Release Fee has been paid.
The Client is explicitly prohibited from reproducing the website design and any pictures supplied by Decco Web Designs.
Liability
Decco Web Designs shall be under no liability whatever to the Client or its customers for any indirect and consequential loss or expense (including loss of profit) suffered by the Client arising out of a breach by Decco Web Designs.
The websites provided by Decco Web Designs are 'fit for purpose' under the following industry standard browsers: Mozilla Firefox, Internet Explorer, Netscape Navigator and Opera. The designs are best viewed in 1024x768 resolution or higher. The designs are best viewed with full 32-bit colour. PCs are required to be Java Script enabled and have the Flash plug-in module.
In the event of any breach of this contract by Decco Web Designs the remedies of the Client shall be limited to the total sum paid by the Client to Decco Web Designs. Under no circumstances shall the liability of Decco Web Designs exceed the total sum paid by the Client for any products and services.
Force Majeure
Neither party shall be liable for any default due to any act of God, strike, lockout, downtime of servers, downtime of an ISP's routers, industrial action, fire, flood, draught, tempest or other event beyond the reasonable control of either party.
